Bishkek, Nov. 5, 2025 /Kabar/. President Sadyr Zhaparov signed the Law of the Kyrgyz Republic "on Amendments to the Criminal Code of the Kyrgyz Republic."
The Law was adopted by the Jogorku Kenesh on September 25, 2025.
The purpose of the Law is to improve the legal regulation of measures to prevent, detect, and suppress fraudulent activities, as well as to increase the effectiveness of protecting the rights and legitimate interests of individuals and legal entities.
The adopted Law amends the Criminal Code of the Kyrgyz Republic aimed at strengthening criminal liability for fraud (Article 209), including by introducing new qualifying elements of fraudulent acts, such as:
- using information and communication technologies or the internet;
- against two or more persons;
- using official position.
Furthermore, amendments have been made to Articles 58, 88, and 92 of the Criminal Code, providing for:
– the exclusion of the possibility of release from criminal liability or the execution of a guilty verdict due to the expiration of the statute of limitations for criminal prosecution for fraud;
– parole, including for fraud, is permitted only upon full compensation for the damage caused by the crime.
Part 1 of Article 370 of the Criminal Code has also been amended, providing for harsher penalties for failure to comply with sentence, court decision, or other judicial act.
The penalty under this provision is a fine of 500 to 1,000 calculated units or imprisonment for three to five years.
